Athletic Club’s Board of Directors consider that, with the sentence handed down in the case of Mr. Jose Maria Núñez, the cycle of iron-clad contracts is over and therefore neither this, nor any other Board of Directors, will have to pay those amounts to any Club employee in future.
The Board also considers quite positive that the verdict by Labour Court Nº 8 rejects the accusations of moral harassment formulated by Mr. Núñez against organisation President, Fernando Garcia Macua, and that it considers the information circulated in the media to have been totally respectful with the plaintiff. The ruling considers that there were no hostile acts appraised and therefore rejects that there ever existed mobbing or harassment against Mr. Núñez, as he had claimed in order to seek an additional two hundred-fifty thousand euros from the organization.
In any case and given that the sentence considers that a dismissal did not exist, but instead a labour contract rescission, and it condemns Athletic Club to pay Mr. Núñez 901,518.16 Euros for the iron-clad, this Board of directors will study the sentence thoroughly and reserves the legal right to lodge an appeal for reversal from the Labour Court of the Basque Country’s Superior Court.
