At the last moment of this evening, Athletic Club has received one notification of the Committee of Competition of the RFEF, expressive of the agreement pronounced in the disciplinary procedings that this Committee has decided to initiate against the player of Athletic Club, Carlos Gurpegi.
Once the decision was studied, Athletic Club and his legal services must reiterate their absolute disagreement with the content, as with regard to the argument as the decission itself and, therefore, with the caution measure adopted in the person of our player Carlos Gurpegi. This decission is flagrantly opposite to the rules about caution measures contained in the rules of the Federation, enforced to this case, as well as the Real Decree of the Sports Discipline and as the Rule of Sport.
The ruling of the Committee is absolutely strange to the same purposes of the caution measure, turning out an anticipation of the sentence, passed before any defense appeal and despite the right to the suspicion of innocence of our player, without valuation of any outstanding circumstances that meet in the case.
Therefore, the decision is surprising, especially taking in account that has been passed by an organ composed by jurists.
It’s surprising the sudden hurry too, after the space of nearly six months since the judged fact, this delay is due to the same Administration. An obvious evidence of the rashness of the Committee of Competition is that in his ruling includes a rate of 19-norandrosterone (notably higher than the established in the analysis), this means that the Committee hasn’t even read carefully the documents of the case.
Finally, Athletic announces that will appeal the decision of the Committee in all the instances that is necessary, trusting the high instances apply the rules that regulate the subject with the proper legal reflection. Without prejudice to the appeal action, Athletic will try the caution suspension of the decision of the Committee so that our player has right to take part in the Sunday’s match.
